A decision under the National Insurance Act can be appealed to the immediately superior body. The Act gives one deadline for both complaint and appeal.
Section 21-12 of the National Insurance Act is titled «Complaint and appeal in social security cases». It states that the deadline for complaint and appeal is six weeks. It runs from when you received the decision, not from the date printed on the letter.
A refusal cites the provision it rests on. For unemployment benefit, the minimum income requirement sits in section 4-4. Which section was applied determines what the appeal is actually about.
Once the complaint route is used, the decision can be appealed to the National Insurance Court. A decision cannot be brought before the ordinary courts until complaint and appeal are exhausted.
